When did they try this?

Aside from it being iffy on several other levels, 
they *can't* patent it, because it's been more than 
a year since it was "made public" (ie they released 
the info programmers need to make use of it at low 
levels). 

So unless they filed the paperwork during that year, 
they are SOL.
