Thus, anyone who makes the software available on a BBS or ftp site would be liable for breach of contract, and presumably for violation of copyright law as well. There may of course be other grounds of criminal and/or civil liability that would apply in such a case. I am not an expert in this area and would suggest that anyone who is contemplating action that might conceivably amount to a breach of any law or of the licence agreement should first obtain advice from a lawyer.
