I'm going to say "it depends" here. There are things that you think you can do in gerber using layer polarities, that fabs will get wrong. We chose to solve the problem (and/or ambiguity) by avoiding polarity completely. We do all the pos/neg/pos math inside pcb and spit out only the results. Whether to blame the gerber spec, or lazy software at the fabs, is up to you :-)
