That should answer to most of questions. That was an unnecessary extension. If you don't provide the sources on the same medium as the binaries, you're infringing the Cygwin license. That's it. The only excemption from that rule is if you purchase a special Cygwin buyout license from Red Hat but I don't think that's what the OP was asking for.
