However, whatever it does do (CreateFile, actually) seems to work on Win2k, at least (albeit with a comment in the code that /* Note: It's not documented in MSDN that FILE_WRITE_ATTRIBUTES is sufficient to change the timestamps... */ [lines 467-468 of winsup/cygwin/times.cc]).
