As Corinna Vinschen said:

   $ chmod 700 /var/empty
   $ chown -R SYSTEM.SYSTEM /var/empty

Is this not working?

What value to you have the environment variable CYGWIN set to?

Did you set CYGWIN in the Control Panel/System applet?

Are you running NTFS as the filesystem on the disk drive that
has Cygwin installed?
