This can be wrong assumption. I've tried ls | less in empty directories
too with no difference.

The problem seems to be tied to piping and not substitution:
"echo `ls`" and "echo `gdate`" are OK
"gdate | less" and "ls | less" are not so OK

BTW, I've added Mark's error output to previous beta and get this:
removing tmp file failed: : Permission denied (EACCES)
