It seems to try to rule out VNC and similar systems - not too good.
IIRC, the statement is not worth the paper it is on in the EU.
The European Copyright Directive even allows dis-assembly of code to make it
interwork with another separately developed piece of code. The limiting of
use by some other pieces of code in the EU is explicitely forbidden in the
directive. The Directive is forcing legislation: it supercedes any other
agreements.
Not that I'd touch XP even with the proverbial twenty-foot rod...
