Yes, both NT4 and W2K return the same value when you call function 30h of Int 21h or subfunction 6 of function 33h of Int 21h. That's the crux of the problem: they both identify themselves as DOS 5.10 (IIRC). You should be able to get the Windows version with Int 2Fh/AX=1600h, but I think NT4 and W2K return the same result there as well.
