It appears I was able to use icacls on root with this syntax

    $ icacls 'C:\.' /save 'C:\acl.txt'
    processed file: C:\.
    Successfully processed 1 files; Failed processing 0 files

    $ icacls 'C:\.' /restore 'C:\acl.txt'
    processed file: C:\.\.
    Successfully processed 1 files; Failed processing 0 files

However after introducing setfacl it fails

    $ setfacl --remove-all /cygdrive/c

    $ icacls 'C:\.' /restore 'C:\acl.txt'
    C:\.\.: Access is denied.
    Successfully processed 0 files; Failed processing 1 files
