One of the comments in this thread mentioned that enforcing the Cygwin
license was "silly".  If a copyright holder fails to enforce his/her
license then it can be shown later in a court of law that the copyright
holder effectively gave up that license.

It is far from silly. It is the obligation of the copyright holder.
