You should not have to worry about the GPL unless you want to use
the cygwin.dll in conjunction with distribution of non-GPL'd
proprietary apps.

I believe the Minimalist GNU-Win32 package

	http://www.fu.is.saga-u.ac.jp/~colin/mingw32.html

allows you to create programs without linking against the
cygwin.dll and (providing I'm not mistaken) that should provide you
with what you want.
