It seems a little haphazard and doesn't always work, but I've seen this error if a file is open in an editor, and you attempt to delete it from outside. Some of the file utilities want to read a file, massage it, delete or rename the original, and rewrite it. Perhaps some variation of this is what is happening? Do you have 'byState' open someplace when the error occurs?
